1. Name of the Site, company data of the seller and ownership of the domain name
1.1 The following General Conditions of Sale and Terms of Use govern the offer and sale of services on the website www.gpmodeling.shop (Site or Platform). The services offered for sale and purchased on the Platform (Services) are offered and sold by Black Duke Travel EOOD, with registered office in Bulgaria, Sofia, 1504, Prof. Milko Bichev street, n. 3, p. 1, (registered with number BG203626680).
1.2 The Platform is owned by Black Duke Travel EOOD, which is also the owner of the domain name.
1.3 Black Duke Travel EOOD is the only counterparty of the user who intends to purchase one or more Services through the Platform and is therefore (1) the person to whom the user directs his order, in order to accept the offer and conclude the sales contract; (2) the person who assumes the pre-contractual obligations arising from the offer towards the user; (3) the person who concludes the sales contract with the user, assuming the related obligations and rights. The purchase contract concluded through the Platform is therefore concluded between the user and Black Duke Travel EOOD.
2. Use of the trademark and/ or surname "GPMODELING.SHOP" and “GPMODELING”
2.1. On the Platform and in communications with customers relating to the Platform, Black Duke Travel EOOD acts under the banner and / or with the use of the surname "GPMODELING" and “GPMODELING.SHOP”. Therefore, when the expression and / or sign "GPMODELING" or “GPMODELING.SHOP” is used on the Platform and / or in communications with customers relating to the Platform or the first-person plural is used, the reference is to be understood, in addition to the Platform, also to Black Duke Travel EOOD.
3. Scope of application of the GCS
3.1 These General Conditions of Sale and Terms of Use (GCS) govern the offer and sale of Services through the Platform by GPMODELING, as well as the provision of the registration service on the Platform itself.
3.2 The GCS are made available to the user through the "General Conditions of Sale" section of the Platform, accessible via the link of the same name in the footer of the Platform.
3.3 The applicable GCS are those in force on the date of transmission of the purchase order.
Before proceeding with the transmission of the order and, therefore, at the conclusion of the purchase contract, the user is required to carefully read all the information that GPMODELING.SHOP provides through the Platform before the conclusion of the contract as well as to examine and approve these GCS, by selecting the appropriate item made available to the user during the purchase procedure.
3.4 These GCS can be modified at any time. Any changes and / or new conditions will be in force from the moment of their publication on the Platform. Users are therefore invited to access the Site regularly and to consult, before making any purchase, the most updated version of the GCS.
3.5 These GCS do not regulate the sale of services by parties other than GPMODELING.SHOP that may be present on the Platform through links, banners or other hypertext links. Before carrying out commercial transactions with these subjects, it is necessary to check their conditions of sale. GPMODELING.SHOP is not responsible for the provision of services and / or for the sale of services and / or goods by such subjects. On the websites that can be consulted through these links, GPMODELING.SHOP does not carry out any checks and / or monitoring. GPMODELING.SHOP is therefore not responsible for the contents of these sites or for any errors and / or omissions and / or violations of the law by them.
4. Purchases on the Platform
4.1 The purchase of the Products through the Platform can take place after registering on the Platform, in the manner set out in art. 5 below, or without registering on the Platform.
4.2. To make a purchase, the user must fill a purchase order form, listing all the desired items, and including the shipping address, shipping method and payment form. This order form must be sent by electronic means or any other system you believe appropriate, after reading and accepting these GCS.
4.3 In the case of orders, coming from anyone, which are anomalous in relation to the quantity of the Products purchased or the frequency of purchases made, GPMODELING.SHOP reserves the right to take all the necessary actions to stop the irregularities, including the suspension of access to the Platform, the cancellation of the registration, or the non-acceptance or cancellation of irregular orders.
4.4 GPMODELING.SHOP finally reserves the right to refuse or cancel orders that come (1) from a user with whom it has an ongoing legal dispute; (2) by a user who has previously violated these GCS; (3) by a user who has been involved in fraud of any kind and, in particular, in fraud relating to credit card payments; (4) by users who have released false, incomplete or in any case inaccurate identification data.
5. Registration on the Platform
5.1 Registration on the Platform is free. To register on the Platform, the user must complete the appropriate form on the Site/Platform. Registration will be confirmed to the user via a specific e-mail.
5.2 The registration credentials allow the user to make purchases on the Platform faster and to carry out all the activities reserved for registered users. They must, therefore, be stored with extreme care and attention. Furthermore, they can only be used by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no third parties have access to them.
5.3 The user guarantees that the personal data provided to GPMODELING.SHOP during the registration procedure and / or during the purchase and / or at any other time, are complete, truthful and referred to the user himself and undertakes to keep GPMODELING.SHOP harmless and indemnified from any damage, compensation obligation and / or sanction deriving from and / or in any way connected to the violation by the user of the guarantees referred to in this art. 5 and / or the violation of the rules on registering on the Platform, purchasing on the Platform and / or keeping the registration credentials.
6. Characteristic of the Products and Prices
6.1 GPMODELING.SHOP is a model online shop specializing in Model Car hobby kits, decals, paints and general accessories. Through the Platform the user can purchase the following products:
Model Car kits;
Decals;
Photoetched Parts;
Paints and Supplies;
Detailing Parts;
Modelling tools;
Display bases;
Figures/Diorama;
Airbrushes and Compressors;
Wheels;
Books;
Art courses and Webinars;
Transkits and Super Detailing;
Diecast Detailing parts;
Gift Vouchers and Cards;
Realized car models by GPMODELING;
Other general hobby modelling accessories.
6.2 All the prices of the products published on the Platform are expressed in Euros and include all applying taxes for EU customers, with the individual exceptions indicated below in paragraphs 6.3 and 6.4 of this chapter, but does not include shipping fees, since they depend on client's shipping preferences (courier, postal service, destination, size, weight). The calculation of the cost of shipping (delivery) depending on the delivery method chosen by the client, weight, volume and destination country of the items is fully indicated in client's shopping cart at the time of checkout.
The indicated amount in the final order confirmation page is the total price, including the price of the products and shipping costs.
Customer order will always be charged in euros, so depending on its bank calculations, its credit card company and the final closing value of exchange rate, the order total might slightly vary in its final charge.
6.3 The cost of products “Hobby Design” trademarks indicated on the Platform does not include import duties and taxes, because the delivery of these goods to the customer is carried out from China by our trade partner. The cost of taxes and import duties depends on the country of destination of the goods and is an expenditure obligation of the customer. Regarding to shipping cost - the calculation of the shipping cost for “Hobby Design” products is fully indicated at the time of checkout when the customer places his order.
The indicated amount in the final order confirmation page is the price, including the price of the products and shipping costs but not including destination country import taxes and import duties for items.
Shipping costs are indicative and may vary according to the supplier's indications or commercial changes.
6.4. Price of goods shipped outside EU (extra – EU countries) are calculated on the Platform without import taxes and import duties, which depends on the volume, the weight and the country of destination of the goods and is an expenditure obligation of the customer. The calculation of the shipping cost is fully indicated at the time of checkout when the customer places his order. Shipping price includes export (extra CEE) customs processing cost of € 2.
The indicated amount in the final order confirmation page is the price, including the price of the products and shipping costs but not including destination country import taxes and import duties for items.
6.5 GPMODELING.SHOP reserves the right to change the price of the products at any time, without notice, it being understood that the price charged to the user will be the one indicated in the order summary and displayed by the user before the transmission of the order and that any changes (increase or decrease) subsequent to the transmission of the same will be taken into account.
6.6. If the user is the holder of a Discount Voucher, he can indicate the code of the relevant Discount Voucher during the purchase process. In this case, the cost of the product will be reduced by an amount equal to the value of the Discount voucher. Discount vouchers can not be combined with each other.
7. Information aimed at concluding the online contract
7.1 In accordance with the Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, GPMODELING.SHOP informs the user that:
- Customer/user makes its purchases through GPMODELING.SHOP virtual store.
- Each order is processed and checked individually.
- To conclude the purchase contract for one or more products on the Platform, the user, after logging in or registering on the Platform/Site, must fill out a form of order in electronic format and transmit it to GPMODELING.SHOP, electronically, following the instructions that will appear from time to time on the Platform.
- The contract is concluded when the order form reaches the server used by GPMODELING.
- Before proceeding with the transmission of the order form, the user can identify and correct any data entry errors by following the instructions on the Site; (iv) once the order form has been registered, GPMODELING.SHOP will send the user the order confirmation to the e-mail address indicated. The order form will be filed in the GPMODELING.SHOP database for the time necessary to execute it and, in any case, in accordance with the law. The essential elements of the order form will be reported in the order confirmation.
7.2 The language available to users for the conclusion of the contract is English. Customer Service is able to communicate with users in English and in Italian.
7.3 The contract for the purchase of products and terms of service is sufficient for use. In the event that the payment story does not take place, the purchase contract will be considered terminated by law. The user will be notified through the Platform that the transaction was not successful and that the order was consequently cancelled.
7.4 After purchasing product on the Platform, GPMODELING.SHOP will send the relevant invoice to the email address supplied by the user. After GPMODELING.SHOP has checked customer’s order, customer will receive an order status confirmation via email. This mode of operation is only possible during our business hours and that several hours may pass until customer receive an order confirmation. Throughout the whole process the order status will be updated by email (stock checking, packaging, payment and shipping time).
For the issuance of the invoice the customer has to provide information through the appropriate form and guarantee that this information is to be true and authentic. The user undertakes to hold GPMODELING.SHOP harmless and indemnified from any damage, compensation obligation and / or sanction that may arise and / or be imposed if such information is not accurate or not true to the truth. No change in the invoice will be possible after it has been issued.
7.5. Products in pre-order status can be bought before arrival to GPMODELING.SHOP warehouse. For pre-order, customer can place an order as usual including the products in pre-order and proceed to checkout. Customer will be charged full price at the end of the checkout process, since those unit/s will be effectively subtracted on arrival from the units for sale to every other customer.
GPMODELING.SHOP does provide an estimated date of arrival for these products, that this date can change due to changes in manufacturer schedules or release dates, which is totally beyond our control. Once stock arrives, pre-orders will be dispatched in strict purchase date order.
7.6. Gift Cards.
The Gift Card of GPMODELING is unnamed and is valid without time limit.
To buy the Gift Card customer registers on the Platform, choose the amount of the Gift Card among available, adds the Gift Card to the shopping cart and pays for the purchase of the Gift Card. To issue a Gift Card, customer must place a separate order without other items in the shopping-cart.
The Gift Card will be delivered by e-mail with personalized message includes the unique Gift Card code and all the information for its correct use.
Its amount can be spent in a single purchase or can be divided into several orders of a smaller amount.
In order to purchase goods on the Platform, using the Gift Card, the client needs to enter the unique Gift Card code at the time of paying for purchases in his shopping cart.
If the amount of the Gift Card exceeds the price of the purchased goods, the balance of the gift card will be available to the customer in his personal account on the Platform.
The customer can always check the available balance of the gift card in his personal account.
8. Terms of payment
8.1 Payment for the products purchased through the Platform can be made through one of the methods indicated on the Platform from time to time. In the event that one of these methods cannot be used in relation to a specific product, this will be clearly indicated on the Platform, at the beginning of the purchase procedure at the latest. The payment methods not available will in any case not be selectable by the user during the appropriate check-out phase.
8.2. Orders through the Platform can be paid using any of the following payment methods:
- Credit card: Worldwide available, and all major credit cards are supported. For your own safety, we do not store any information about customer credit card on our systems.
For both customers security and ours, we also require that customer bank supports the secure online purchase protocol for all credit card payments, forcing users to authenticate with its own bank during the payment process.
NOTE: If your credit card purchases fail with the error "Key holder without secure purchase" (code 9104), please check with your bank for the activation of the Verified by VISA™ protocol on your VISA, MasterCard Secure Code™ on your MasterCard, or secure online purchase equivalent on your credit card.
8.3. Payments by the Gift Card.
In order to purchase goods on the Platform, using a Gift Card, the client needs to enter the unique Gift Card code at the time of paying for purchases in his shopping cart.
If the amount of the Gift Card exceeds the price of the purchased goods, the balance of the gift card will be available to the customer in his personal account on the Platform.
The customer can always check the available balance of the gift card in his personal account.
To purchase goods on the Platform, using the Gift Card, the client needs to enter the unique Gift Card code at the time of paying for purchases in his shopping cart.
If the amount of the Gift Card exceeds the price of the purchased goods, the balance of the gift card will be available to the customer in his personal account on the Platform.
The customer can always check the available balance of the gift card in his personal account.
9. Shipping
9.1 GPMODELING.SHOP delivers worldwide. All orders are shipped using a traceable method, via either Postal Service or Courier Service (customer’s choice).
Shipping costs are automatically calculated by our purchasing process, according to weight, volume and destination country of the goods in customer’s shopping cart. All customers get tracking information via email once their order is shipped.
Shipping costs for goods shipped outside EU (extra – EU countries) are calculated on the Platform include also export (extra CEE) customs processing cost of € 2.
Shipments to non-continental and/or remote destinations may be subject to additional transit times and shipping surcharges. Remote is defined as islands and highlands; or a post code/zip code that is difficult to serve; or a suburb/town that is distant, inaccessible or infrequently served. GPMODELING.SHOP will contact you if your address is classed as remote for the additional surcharge fee.
9.2 GPMODELING.SHOP offers following shipping options:
- Courier service: available for most European Community countries, and also in selected countries worldwide.
- Postal service: only available for Italy.
10. Sending Prohibited Goods and Dangerous goods (Paints, Thinners, Flammable Liquids etc.)
10.1 Dangerous goods shipping is available unrestricted via Courier Road services for all surface destinations (Europe), and available but restricted by IATA regulations worldwide.
10.2 Shipping of Dangerous goods will have an additional surcharge.
10.3. Please note that Spray paints, contacting paints and other flammable liquids can only be shipped to most of destinations within Europe (except Greece) via Courier Road service. They cannot be shipped to other countries outside Europe. We are working to get IATA permit to send it.
10.4. It is the Customers responsibility to check with your local Postal Operator to confirm if any items being purchased are classed as Prohibited Goods (Paints, Thinners, Flammable Liquids etc.) within your country. If you Customer purchased a product, item/s which is classed as Prohibited Goods and it is not delivered, GPMODELING.SHOP can NOT offer refunds. If the item/s are returned to GPMODELING.SHOP for this reason, we will refund the value of the items returned minus any shipping/packing cost.
10.5. Our clients may also Pick up their orders themselves at the GPMODELING.SHOP office in Italy, which is situated in Italy, Caserta, Carlo Santagata street, n. 24.
Pick up is possible for orders paid on the Platform. When placing an order, the customer should leave his contact information, by which GPMODELING.SHOP can contact the customer and inform about the readiness of the items for delivery in our warehouse during working hours.
10.6 The client who placed an order on the GPMODELING.SHOP platform undertakes to receive the order in the way that the client chose when placing the order. If the customer refuses to accept the order delivered to the specified address, the ordered goods must be returned back to our warehouse. In this case, GPMODELING.SHOP undertakes to return the cost of the goods to the client after returning the item to our store within 7 working days, minus all transport costs for the delivery and return of the goods. Therefore, shipping costs are covered by the customer and are non-refundable.
In case of loss of the parcel on the way due to the fault of the transport company (DHL, FedEX, SDA and others), GPMODELING.SHOP is responsible to the customer for the lost order in the event that the transport company officially confirms the fact of the loss of the order. The amount of financial liability of GPMODELING.SHOP to the client for the order lost on the way, in case of proper dispatch of the order to customer, is limited to the limit of liability of the transport company chosen by the client. So, in case of loss of the order, the transport company compensates in full the transportation costs and partially the cost of the lost goods, within the limits specified in its policy. For example, in 2022, the transport company FedEX compensates 27 euros for each kilogram of the lost parcel, regardless of the real value of the goods.
In order to provide customers with full coverage of the cost of ordered items, GPMODELING.SHOP offers the possibility of shipping insurance. This option is available to all customers on the check out page. If the customer chooses the shipping option with full insurance, in case of loss or damage to the parcel due to the fault of the transport company, the client receives immediately after reporting the loss or damage to the goods, full compensation for transport costs and the cost of the order.
GPMODELING.SHOP is not responsible for loss, damage, violation of delivery dates if the client chooses a delivery method, including a courier service, different from that GPMODELING.SHOP offered on the Platform. In this case, all risks are assumed by the client.
11. Cancellation and Return policy
11.1 Customer may cancel its order by giving us notice of cancellation within 14 calendar days of receiving their original order. GPMODELING.SHOP allows our customers to return any faulty products, incorrectly shipped products or cancel order and return those products that for any reason customer does not want (although this last case does not apply to products served "on demand"). Such notice should be given by emailing to the Customer support to the e-mail address, such as: support@gpmodeling.shop
11.2 If customer is cancelling because of any problem with the goods, we ask him to notify us of the problem at the time of cancellation.
11.3 If the return is accepted, within 3 days we’ll send our customer instructions on how and where to send the package. Items sent back to us without first requesting a return will not be accepted.
11.4 Customer can activate a return by delivering the order to an GPMODELING.SHOP warehouse in Italy, 81100, Caserta (CE), via Carlo Santagata, n.24.
11.5 Once customer has requested a return, he has an additional 5 calendar days to return the products by post or courier service at the customer's choice. The shipping costs will be at customer's expense.
The paper documentation customer received with his order, including the delivery note, must be included in the package.
The package should be sent to our warehouse located at the following address: GPMODELING.SHOP, Carlo Santagata street, n. 24, Caserta (CE), Italy, 81100.
11.6 We recommend that customer chooses a traceable delivery service, so that he can track his shipment at all times.
11.7 GPMODELING.SHOP is not responsible for the loss, damage of goods sent by the customer in this method.
11.8 We also provide customers with the opportunity to return the goods to GPMODELING.SHOP by the DHL courier partner service at special rates, agreed with DHL company. In order to use this option to return the goods, the customer must inform GPMODELING.SHOP in the return request about the intention to return the goods using this method. This request should be given by emailing to the Customer support to the e-mail address, such as: support@gpmodeling.shop
If it is possible to activate this return method, we will send the customer a confirmation letter with information about the timing of the return and a Return shipping label.
When choosing this method of return, the customer does not pay shipping costs when sending the goods. Shipping charges will be deducted from the total amount returned to the customer after return confirmation.
11.9 The customer should prepare the package according to the instructions sent out by GPMODELING.SHOP, print the Return shipping label and put it in to the package. The paper documentation customer received with his order must be included in the package.
11.10 If the product or the order is faulty or incomplete, customer should get in contact with GPMODELING.SHOP beforehand within 4 calendar days of receipt at support@gpmodeling.shop , so GPMODELING.SHOP can claim the manufacturer and send him the necessary parts to get a perfect quality product/ order.
11.11 Returned items must reach our warehouse in perfect mint conditions and with unopened and undamaged original packaging, and will be replaced by similar products, if customer asked about it, or refunded on the payment method that customer used to place the original order.
11.12 As soon as the return is delivered to our warehouse, the Customer Support Department will carry out the appropriate checks. After the positive outcome of the quality control, GPMODELING.SHOP will send customer an email to confirm the return and the arrangement of the refund. Within 3 – 15 calendar days customer will be able to verify the crediting of the sum on the payment method used in the purchase phase.
11.13 Customer can also request the return of products purchased with a Gift Card.
11.14 Shipping or returns costs cannot be refunded, except when the return is caused by a processing mistake on our side or defects.
11.15 If returned products didn't arrive to our warehouse in perfect conditions, a partial refund will be made according to their state.
11.16 Unfortunately, we cannot accept returns of model cars, created by GPMODELING designer Galotta Pasquale. These products are exclusive works, created in a single unique copy at the customer’s request.
11.17 We also do not accept returns for hazardous materials, flammable liquids, or gases and Gift Cards.
11.18 If customer has notified GPMODELING.SHOP of a problem with the goods, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.
We will not be liable to customer for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to customer by way of compensation other than any refund we make under these conditions. This does not affect customer statutory rights as a consumer, nor is it intended to exclude our liability to customer for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
As stated above all return will be requested and validated beforehand by GPMODELING.SHOP Customer Service. You can always contact us for any return question at support@gpmodeling.shop
11.19 In the event that the client has received an order with damaged packaging and / or goods inside the package, it is necessary to immediately contact GPMODELING.SHOP at support@gpmodeling.shop within 7 working days with a corresponding application and a photo of the damage.
In case of failure to comply with these requirements and conditions, GPMODELING.SHOP is released from liability for compensation for the cost of damaged goods.
12. Limitations of use of the Platform
12.1 The user acknowledges that the Platform and its contents cannot be used for illegal purposes. The user also undertakes to respect the intellectual property right, the copyright, the right on patents and / or trademarks of GPMODELING.SHOP and / or third parties.
The user undertakes not to infringe the intellectual property right, author, patents and / or trademarks owned by GPMODELING.SHOP, and /or third parties concerning any content on the Platform, including but not limited to: logos, images (drawings and / or iconographic material, including photographs), sounds, music, videos, software, texts, icons, graphics, databases as well as software programs, source codes, application projects, formulas and algorithms.
